Client Services Agreement

Last updated: August 20, 2026

This is the agreement that governs paid work — builds, the Site Care Plan and monthly retainers. If you are just browsing the site, the document you want is our Website Terms of Use. We publish this in full, before you ask for it, for the same reason we publish our prices.

1. This Agreement and How You Accept It

This Client Services Agreement (the “Agreement”) governs website design, build, facelift, Site Care Plan and monthly retainer services provided by GoVisible Web (“we”, “us”) to you (the “Client”).

Requesting a free preview does not create this Agreement and commits you to nothing. You may look at your preview and walk away, and you will owe us nothing and hear from us no further if you say so.

This Agreement takes effect when you accept your preview and ask us to proceed — by confirming acceptance through the link we send you, by signing a proposal or order form referencing this Agreement, or by making a payment toward a build or retainer. Whichever comes first. The proposal or order form sets out the tier, price and scope for your project; this Agreement sets out everything else, and the two are read together.

If any term of a signed proposal or order form conflicts with this Agreement, the signed document controls for that project.

2. Description of Services

GoVisible Web provides custom website design and build services for small businesses across the United States, across industries including but not limited to roofing, HVAC, hardscaping, remodeling, foundation repair, accounting, legal, veterinary, salon and spa services, wedding planning, and wedding photography. Services include one-time website builds, website facelifts/rebuilds, the Site Care Plan (ongoing technical maintenance), and optional monthly content retainers. Specific deliverables for each service tier are described on our Services and Pricing pages, which are incorporated into this Agreement by reference.

We build marketing and informational websites. We do not build patient or client portals, login or account systems, document upload or storage systems, payment processing systems, or any system that collects, stores, or transmits regulated data. Where your business needs those, we integrate with a third-party platform you contract with directly — see the Regulated Data section below.

Our Services are offered exclusively to businesses organized under the laws of, and operating primarily within, the United States. By requesting a preview, placing an order, or otherwise using our Services, you represent and warrant that you meet this requirement. We do not knowingly offer Services to individuals or entities located outside the United States, and we reserve the right to decline service, or to terminate an existing engagement, if we determine this requirement is not met.

3. AI-Generated Content — Client Responsibility to Verify

Website copy, page content, FAQ answers, meta descriptions, and other text delivered as part of your build may be generated with the assistance of artificial intelligence tools, then reviewed by our team before delivery. You are responsible for reviewing all factual claims in your preview — including but not limited to pricing, licensing numbers, professional credentials, service descriptions, and any guarantees — before approving the preview and authorizing your site to go live.

By approving your preview (via email reply, form submission, or payment), you confirm you have reviewed the content for accuracy. You agree to indemnify and hold GoVisible Web harmless from any claim, loss, or damage arising from inaccurate factual content that you approved for publication without correcting it.

4. No Guarantee of Search Rankings or Results

We implement technical SEO best practices — meta tags, schema markup, Google Business Profile setup, sitemap submission, and Search Console verification — on every build. We do not guarantee specific search engine rankings, position improvements, traffic volume, leads, or sales. Search rankings are determined by Google and other search engines based on proprietary algorithms outside our control. Results vary by market, competition, and content, and may take 3-6 months or longer to materialize, if at all.

5. No Guarantee of Accessibility Compliance

We apply common accessibility practices during development — semantic HTML structure, alternative text fields for images, labelled form controls, keyboard-operable navigation, and color contrast targets drawn from the Web Content Accessibility Guidelines (WCAG) — and we run automated accessibility checks before launch.

We do not certify, warrant, or guarantee that your website conforms to WCAG at any level, or that it complies with the Americans with Disabilities Act, Section 508 of the Rehabilitation Act, the California Unruh Civil Rights Act, the New York State or City Human Rights Laws, or any other accessibility law, regulation, or standard in any jurisdiction. Automated accessibility testing detects only a portion of possible accessibility barriers and is not a substitute for a manual audit by a qualified accessibility professional, nor for legal advice.

Accessibility is affected on an ongoing basis by content you add or change after launch, by third-party embeds and integrations you enable, and by evolving standards and case law. You are responsible for determining which accessibility obligations apply to your business and for obtaining any audit, remediation, or legal advice you require. If accessibility conformance is a requirement for your business, tell us before you accept your preview so we can discuss scope — a conformance audit is not included in any tier.

6. No Guarantee of Professional or Industry Compliance

Many of the businesses we build for are governed by advertising, solicitation, or communications rules specific to their profession or industry — including but not limited to state bar rules of professional conduct for attorneys, IRS Circular 230 for tax practitioners, SEC and FINRA advertising rules for financial professionals, state medical, dental, veterinary, and cosmetology board rules, state insurance regulations, and federal rules on endorsements and testimonials.

We do not provide legal, regulatory, or compliance advice, and we do not certify, warrant, or guarantee that your website, its content, or any marketing material we produce complies with any such rule in any jurisdiction. This includes content we draft or generate on your behalf.

You are responsible for reviewing and approving all published content against the rules that govern your profession, including any restrictions on testimonials, reviews, client results, comparative claims, specialization or expertise claims, disclaimers, and required notices. If your profession requires specific language, disclaimers, or a pre-publication review, tell us before you accept your preview so we can build it in — we cannot know which rules apply to you and we do not monitor them on your behalf.

7. Regulated Data — What We Do Not Handle

We provide marketing and design services only. We build informational websites: pages describing your services, your team, your hours and location, galleries, and basic contact forms that collect a name, phone number, email address, and a short message.

We do not create, receive, maintain, or transmit Protected Health Information (PHI) on behalf of any client. We are not a HIPAA Business Associate and we do not enter into Business Associate Agreements. We do not store, process, or transmit Social Security numbers, financial account numbers, payment card data, credit or background-check data, tax documents, case files, or medical records, and we will not build a form field that requests them.

Where your business requires client intake, appointment scheduling, document exchange, payment processing, or a client login, that function is provided by a third-party platform that you contract with directly — for example your practice management system, patient portal, secure document platform, or payment processor. We link to it or embed it; we do not host, store, or receive the data submitted through it. See the Third-Party Services section below for how that works technically.

You are solely responsible for any portal, form, integration, or third-party platform that collects regulated data in connection with your website, for selecting a vendor appropriate to your regulatory obligations, for entering into any agreement that vendor requires, and for that platform's compliance. If your business requires that we build or host a system handling regulated data, that is outside the scope of this Agreement and of every service tier we offer; you agree not to direct us to build such a feature, and we may decline any request to do so.

8. Payment, Delivery & Acceptance

We aim to deliver a free, no-obligation preview site within 48 hours of your completing our onboarding form. No payment is required to receive or review your preview. One-time build fees are invoiced when you accept the preview and choose to move forward — this is what begins the revision and launch process below.

Following payment, your build includes a set number of revision rounds depending on your tier — one round (Starter), two rounds (Professional), or three rounds (Premium) — whether you're getting a new build or a Rebuild on an existing domain. You have 3 business days (Starter), 4 business days (Professional), or 5 business days (Premium) per round to submit feedback. After your included rounds, we jointly review the completed site for factual accuracy and any regulatory or industry-specific requirements applicable to your business, and your site launches within 24 hours of your final approval. Actual timelines may vary based on domain registration, third-party integrations, and your responsiveness to review requests. Revisions requested beyond your included rounds are billed at our then-current hourly add-on rate ($147/hour, quoted before work begins).

Professional and Premium builds (new or Rebuild) also include post-launch support — 1 hour for Professional, 3 hours for Premium — usable within 30 days of go-live for minor fixes outside the revision process. Starter does not include post-launch support hours. Unused hours don't roll over; additional support is billed at $147/hour, quoted before work begins.

Your written or electronic acceptance of the preview (via email reply, form submission, or payment) constitutes sign-off on the delivered site build. Submitting payment after preview acceptance waives your right to initiate a chargeback or payment dispute for completed design and development work.

9. The Site Care Plan

Every build and facelift includes a complimentary period of the Site Care Plan (3, 6, or 12 months depending on tier, as specified at purchase), covering SSL certificate management, uptime monitoring, DNS support, monitoring of your domain's renewal date, a monthly automated health check, and up to one technical support request per month (up to 30 minutes). Your domain is registered and remains under your own account, billed to your own payment method; we manage its technical settings and watch for renewal issues, but we do not pay for, mark up, or take ownership of the registration itself. After your included period, the Site Care Plan automatically continues at $89/month or $890/year unless cancelled.

The Site Care Plan does not include new content creation, Google Business Profile management, social media posting, or design changes/new pages — these are available as paid add-ons or through a monthly retainer. Additional support requests beyond the included allotment are billed at our then-current hourly rate, quoted before work begins.

You may cancel the Site Care Plan at any time with 30 days' written notice. Upon cancellation, we will deliver all site source files, a domain transfer authorization, and relevant login credentials within 5 business days. You retain ownership of your domain name, content, brand assets, and any accounts (e.g., Google Business Profile) at all times.

10. Self-Managed Handoff

The self-managed tier is your build tier plus an independence fee ($897 Starter, $1,297 Professional, $1,897 Premium) that reflects the Site Care and Retainer revenue we forgo over the life of the engagement — not a fee for extended support. You get the same revision process as your tier, no Site Care Plan at any point (not even the complimentary period standard builds include), and your source files immediately at go-live — no 30-day window, since there's nothing beyond the standard build process to wait for. We keep no ongoing access to anything hosting your site from that point on.

Once you have your files — through a self-managed handoff, or if you ever cancel — you can modify, host, and operate your site independently: directly, through anyone you authorize, or through an AI-assisted coding tool (GitHub Copilot, ChatGPT, or similar). Our warranties apply only to the site as delivered at handoff, not to anything you change afterward, and we're not liable for downtime, data loss, or defects arising after that point. Any help we provide once your engagement has concluded is billed at our standard hourly add-on rate, since Site Care and Retainer services no longer apply.

11. Security

We implement reasonable technical safeguards for the sites we build and the services we manage, including TLS/SSL encryption, domain and DNS access controls, and the infrastructure-level protections (including DDoS mitigation and edge-network security) provided by our hosting and CDN partners. The Site Care Plan's uptime monitoring and monthly health check are intended to help us detect and respond quickly to issues, including signs of compromise.

Worth stating plainly alongside that: the scope of what we hold is deliberately small. We do not maintain a database of your customers, patients, or clients, and regulated data does not pass through our systems — see the Regulated Data section above. A security incident affecting our infrastructure cannot expose information we never receive.

We do not guarantee that your site, domain, or related accounts will be free from unauthorized access, malware, denial-of-service attacks, or other malicious activity — including incidents arising from third-party services, compromised credentials outside our control, or vulnerabilities in third-party software we integrate but do not control. If a security incident affecting your site is suspected, we will make commercially reasonable efforts to investigate and remediate as part of your Site Care Plan; work outside the scope of included Site Care services may be billed separately, quoted before work begins.

12. Monthly Retainers

Monthly retainer plans replace the Site Care Plan and add ongoing content services (blog posts, Google Business Profile posts, social media content, review monitoring, and reporting) as described on our Services page. Retainers bill monthly in advance. Content already delivered is non-refundable.

Onboarding fee (Professional and Premium Retainers). Professional and Premium Retainers include one-time work in the first month — a competitor report and local SEO audit (Professional), or directory listings setup, a full competitor analysis, and a review-generation campaign build (Premium) — that is billed separately as a one-time onboarding fee, due at signup and in addition to your first month's recurring fee. This fee is non-refundable once that work has been delivered. The Starter Retainer has no onboarding fee.

Minimum term (Professional and Premium Retainers). Professional and Premium Retainers require a 3-month minimum term from the start date, reflecting the time SEO and content work typically take to show results. If you cancel before completing the minimum term, the remaining monthly fees for the unexpired portion become due immediately. The Starter Retainer has no minimum term and is cancellable at any time.

Cancellation and notice. After any applicable minimum term, retainers may be cancelled with 30 days' written notice. Cancellation notice does not stop billing immediately — your then-current billing cycle continues in full, and one additional 30-day cycle is billed from the date notice is given, consistent with the notice period.

13. Referral Partner Program

If you refer a business that becomes a paying GoVisible Web client, you receive a $100 reward once that client's first payment has cleared. How it is paid depends on whether you are a client yourself:

  • If you are a current client, the reward is applied as a $100 credit against your next invoice — your Site Care Plan, retainer, or a future build. Credits do not expire while your account is active, and are not redeemable for cash.
  • If you are not a client, the reward is paid in cash, up to a maximum of five rewards per calendar year. Beyond five, we will talk to you about a formal partner arrangement rather than continuing under this program.

The reward amount and any promotional terms may change for future referrals at our discretion — the terms in place when your specific referral converts are the terms that apply to that referral. Rewards are limited to one per unique referred business, are contingent on the referred business actually becoming a paying client (not simply requesting a preview), and may be forfeited if we determine a referral was fraudulent, self-referred, or made in violation of this Agreement. We may modify, pause, or discontinue the program at any time; changes do not affect rewards already earned for referrals that converted before the change.

We do not ask for your Social Security number or any other taxpayer identification number. The annual cap above keeps cash rewards below the threshold at which we would be required to report them, and an invoice credit is a reduction in what you owe us rather than a payment to you. If a future arrangement ever required tax reporting, we would use a third-party payment provider that collects and holds that information directly — consistent with the Regulated Data section above, we would not collect or store it ourselves.

You remain responsible for your own tax position on any reward you receive, and for complying with any disclosure obligations that apply to your referral relationship under applicable law — for example, the FTC's endorsement guidelines require you to disclose a material connection when you recommend us publicly. That applies to an invoice credit exactly as it does to cash.

14. Third-Party Services

Delivering our Services may involve third-party providers, including but not limited to domain registrars, hosting/CDN providers, payment processors, email delivery services, and scheduling tools. We are not responsible for outages, data handling practices, or policy changes of third-party providers, though we will make commercially reasonable efforts to notify you of any that affect your site.

Where your website links to or embeds a third-party platform — a scheduling tool, a client or patient portal, a secure document exchange, a financing application, or a payment processor — information submitted through it travels directly from the visitor's browser to that provider and does not pass through our infrastructure. We do not receive, store, or have access to it. That provider's own terms and privacy policy govern the data, and any agreement required for your regulatory obligations is between you and that provider.

Basic contact and inquiry forms we build are the exception: those submissions are handled by our form infrastructure and forwarded to you. They collect contact details only, as described in the Regulated Data section, and are covered by our Privacy Policy.

15. Limitation of Liability

To the maximum extent permitted by law, GoVisible Web's total liability for any claim arising from the Services is limited to the amount you paid us for the specific service giving rise to the claim in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or lost-profit damages, including lost business revenue resulting from site downtime, security incidents, search ranking changes, or third-party service disruptions.

16. Governing Law

This Agreement is governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising under this Agreement will be resolved in the state or federal courts located in Georgia.

17. Changes to This Agreement

We may update this Agreement from time to time, and material changes will be reflected by an updated “Last updated” date above.

A change does not alter the terms of work already underway. The version you accepted governs your project through to delivery, and governs any Site Care Plan or retainer for the remainder of its current term. A revised version applies to new work you accept after the change — a further build, a new retainer, or a renewal — at the point you accept it.

For an ongoing Site Care Plan or retainer that renews automatically, we will give you at least 30 days' notice by email before a materially changed version applies to your renewal, so you have time to review it or cancel.
